PUBLIC AGREEMENT (OFFER)
for the purchase of NAMAD digital educational materials

This document is an official and public offer of Sole Proprietor Alina Andriivna Zabolotna to conclude an agreement under the terms set out below, in accordance with Articles 633 and 641 of the Civil Code of Ukraine.

The fact of payment for an order, use of the website, or receiving access to digital materials constitutes full acceptance by the Buyer of the terms of this Public Offer.

1. General Provisions

1.1. Sole Proprietor Alina Andriivna Zabolotna (hereinafter referred to as the “Seller”) offers digital goods and services posted on the website namad.info.

1.2. This agreement is a public offer and defines the procedure for purchasing digital educational materials (PDF files, instructions, checklists).

1.3. The agreement is considered concluded from the moment the Buyer pays for the order or from the moment the Buyer actually receives access to the digital content.

2. Terms and Definitions

Seller – Sole Proprietor Alina Andriivna Zabolotna.
Buyer – any legally capable person who has paid for a digital product.
Website – the web resource namad.info.
Product / Digital Product – PDF guides, instructions, checklists and other electronic materials.
Service – providing access to digital content.

3. Rights and Obligations of the Parties

3.1. The Seller is obliged to:

provide access to the digital product after payment;

ensure proper access to the files;

maintain confidentiality of the Buyer’s personal data.

3.2. The Seller has the right to:

change the terms of this offer;

change prices for goods;

refuse service in case of violation of the terms of use by the Buyer.

3.3. The Buyer has the right to:

receive complete information about digital goods;

contact support regarding access to materials.

3.4. The Buyer is obliged to:

provide correct contact information;

pay for the product;

not transfer digital materials to third parties.

4. Prices and Payment Procedure

4.1. Prices are indicated in Ukrainian hryvnias on the website namad.info.

4.2. Payment is made by bank cards through payment systems (Visa, Mastercard).

4.3. Payment is considered completed after confirmation by the bank.

4.4. The current price of the product is the price indicated at the moment of placing the order.

5. Delivery and Transfer of Digital Products

5.1. All NAMAD products are digital and delivered automatically after payment.

5.2. Delivery format:

• download link;
• or access via e-mail/account.

5.3. Delivery time – instantly after successful payment.

6. Guarantees and Liability

6.1. The Seller guarantees that the files are functional.

6.2. The Seller is not responsible for:

• technical failures on the Buyer’s side;
• loss of access due to problems with e-mail or device;
• incompatibility with the Buyer’s software.

6.3. All claims must be submitted in writing to the support e-mail.

7. Refund and Cancellation Policy

7.1. Refunds are possible in the following cases:

• double charge;
• technical payment error;
• an incorrect file was provided;
• the file cannot be opened (confirmed by support).

7.2. Digital products are non-refundable after download in accordance with the Law of Ukraine “On Consumer Protection”.

7.3. Refunds are made using the same payment method used for the purchase within up to 10 (ten) business days after the refund is approved.

8. Confidentiality and Personal Data

8.1. Personal data processing is carried out in accordance with the Privacy Policy.

8.2. The Seller undertakes not to disclose the Buyer’s personal data to third parties except as required by law.

9. Force Majeure

9.1. The parties are released from liability for failure to fulfill obligations in case of force majeure circumstances:

• war;
• emergency situations;
• technical failures of internet providers;
• natural disasters.

10. Term of the Agreement

10.1. The agreement is valid from the moment of acceptance (payment) until full fulfillment of obligations by the parties.

10.2. The agreement may be terminated by mutual consent of the parties or in other cases provided by law.

11. Dispute Resolution

11.1. Disputes shall be resolved through negotiations.

11.2. If no agreement is reached, disputes shall be resolved in court in accordance with the legislation of Ukraine.

13. Final Provisions

13.1. The Seller may change the terms of this Offer without prior notice.

13.2. The electronic form of the agreement is recognized as equivalent to a written agreement in accordance with the legislation of Ukraine.
